WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

By entering and using the facility operated by Hook It Golf LLC, you acknowledge the inherent risks associated with golf and related activities, including the risk of serious injury or death. Golf balls may travel at high speeds, golf clubs may be swung forcefully, and ricochets may occur inside enclosed simulator bays. By entering the premises, you agree that you are participating entirely at your own risk and you fully release Hook It Golf LLC from liability as outlined below.

Use of the facility is conditioned upon agreement to all terms of this Waiver. This Waiver remains valid for all future visits unless revoked by Hook It Golf LLC.

RELEASE OF LIABILITY & ASSUMPTION OF RISK

On behalf of myself, my spouse, my children or wards (if any), and their respective successors and assigns (collectively, the "Releasing Parties"), and in consideration of the services and activities provided by Hook It Golf LLC and its managers, members, employees, agents, officers, directors, affiliates, independent contractors, volunteers, insurers, facility operators, premises owners, and any entity acting on its behalf (collectively, the "Released and Indemnified Parties"), I agree as follows:

1. RELEASE AND INDEMNITY

I hereby release, discharge, defend, hold harmless, and indemnify the Released and Indemnified Parties from any and all claims, causes of action, damages, liabilities, expenses, losses, and costs (including attorneys’ fees), known or unknown, arising from or related to:

• my presence on the premises,
• my participation in golf or related activities,
• equipment use or malfunction (including simulators, balls, tees, mats, screens, flooring, and club use),
• slips, trips, falls, or any injury anywhere on the premises,
• or any act, omission, negligence, or gross negligence by any party.

This waiver includes claims under common law, statute, ordinance, or rule, whether in law or equity.

I agree not to sue or assist in any claim against the Released and Indemnified Parties for injuries, damages, or losses arising during my visit.

2. ACKNOWLEDGEMENT OF RISKS

I acknowledge that:

• Golfing—especially indoors—is inherently dangerous.
• Golf balls, tees, and clubs may travel or swing at speeds exceeding 100 mph.
• Ricochets, mis-hits, and unintended ball paths may occur.
• No amount of supervision or instruction eliminates risk.
• Injuries may include bruises, broken bones, concussions, eye injuries, or death.

I voluntarily accept all such risks for myself and the Releasing Parties.

3. ASSUMPTION OF RISK & RESPONSIBILITY FOR LOSS

I knowingly assume all risks, including injuries caused by:

• my actions,
• the actions of others,
• equipment failure or misuse,
• pre-existing physical or medical conditions,
• unsafe conduct,
• or conditions of the premises.

I accept full financial responsibility for injuries and property damage incurred by any Releasing Party.

I agree that Hook It Golf LLC is not responsible for theft or loss of personal belongings.

4. INJURIES BY AND TO THIRD PARTIES

I understand that:

• I may be injured by the actions of other guests.
• My actions may injure others.

In either scenario, I agree to indemnify the Released and Indemnified Parties from all claims arising from such incidents.

5. INSURANCE

I certify that I have adequate insurance or personal financial resources to cover medical costs, injuries, damages, or claims arising from my participation or that of the Releasing Parties.

6. REPRESENTATIONS

I represent that:

• All participants under my responsibility are physically able to participate safely.
• I have legal authority to sign this agreement for any minor child or ward.
• All participants will follow instructions, posted rules, and safety guidelines.

I agree to indemnify Hook It Golf LLC for any claim asserting that I lacked authority to sign on behalf of a minor.

7. BASIS OF BARGAIN

I acknowledge that Hook It Golf LLC would not permit use of the facility without this waiver, and that this waiver is a material part of the agreement.

8. CHOICE OF LAW AND VENUE

This Agreement is governed by North Carolina law. All disputes shall be resolved exclusively in North Carolina courts.

I agree to reimburse the Released and Indemnified Parties for legal fees incurred enforcing this Agreement.

9. MODEL & MEDIA RELEASE

I grant Hook It Golf LLC the unrestricted right to record, photograph, or video me or my minor child, and to use such media for advertising, training, or promotional purposes without compensation.

I waive any right to inspect or approve such materials.

10. INDEMNITY FOR DAMAGE TO PROPERTY

I agree to indemnify Hook It Golf LLC for any damage caused by me, my spouse, my children, or anyone under my supervision, including but not limited to damage to:

• TrackMan units
• Screens, mats, cameras, sensors
• Flooring, walls, TVs, computers
• Any other Hook It Golf LLC property

FACILITY RULES & SAFETY GUIDELINES

All guests must follow these safety rules at all times:

• A confirmed tee time or bay reservation is required.
• Please cancel with 24-hour notice when possible.
• No metal spikes.
• No food or drink inside simulator bays.
• Facility is under 24/7 video and audio surveillance.
• Do not tamper with cameras, simulators, or facility equipment.
• Use only clean clubs.
• One person in the hitting area at a time.
• Always check surroundings before swinging.
• Practice swings must be done on the mat.
• Keep spectators outside of the swing area.
• All shots must be directed forward.
• Report any accidents immediately.
• Guests are financially responsible for any damage caused by failure to follow these rules.
• Failure to follow staff instructions or rules may result in immediate removal without refund.

PROHIBITED SUBSTANCES

Bringing alcohol, drugs, vapes, or smoking materials into the facility is strictly prohibited.

Violation will result in immediate removal and may result in financial liability for damages.
